Terms of Service for ACP Billing

Effective Date: February 7, 2026

The Law Office of Kevin Gunther ("we," "us," or "our") licenses the ACP Billing application (the "App") to you ("you" or "User") subject to these Terms of Service ("Terms"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

1. Scope of License

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App on devices owned or controlled by you, strictly in accordance with these Terms and the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Your Data & Responsibility

A. Local Storage & Backups

ACP Billing is a "Local-First" application. The data you enter (dockets, time entries, client info) is stored locally on your device or within your personal cloud accounts (iCloud/Google Drive).

We do not host your data. We cannot restore lost data if you delete the App or lose your device.

Your Responsibility: You are solely responsible for maintaining backups of your data. We recommend regularly exporting your data or enabling iCloud Backup.

B. Accuracy of Legal Documents

The App provides automation tools to generate legal forms (e.g., Notices of Appearance, Vouchers) and invoices.

  • Professional Judgment: These tools are for assistance only. You are responsible for reviewing all generated documents for accuracy, legal compliance, and completeness before filing or submitting them.
  • No Legal Advice: The App provides administrative support tools and does not constitute legal advice or an attorney-client relationship between you and The Law Office of Kevin Gunther.

3. Third-Party Services

The App integrates with third-party services, including Google Drive, iCloud, and SharePoint.

  • Availability: We do not control these services and are not responsible for their downtime, data loss, or changes in their APIs that may affect App functionality.
  • Compliance: Your use of these services is subject to their respective terms and privacy policies.

4. Prohibited Uses

You agree not to:

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
  • Use the App for any illegal purpose or in violation of any local, state, national, or international law.
  • Use the App to transmit viruses, malware, or other malicious code.
  • Rent, lease, loan, sell, redistribute, or sublicense the App.

5. Intellectual Property

The App, including its code, graphics, user interface, and editorial content, is the proprietary property of The Law Office of Kevin Gunther and is protected by copyright and other intellectual property laws. You acquire only the right to use the App as licensed herein.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITH ALL FAULTS AND DEFECTS AND WITHOUT WARRANTY OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS, BE COMPATIBLE WITH YOUR SPECIFIC BILLING PORTALS, OR BE ERROR-FREE.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE LAW OFFICE OF KEVIN GUNTHER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • LOSS OF DATA OR BILLING RECORDS;
  • REJECTION OF COURT FORMS OR VOUCHERS;
  • LOSS OF REVENUE OR PROFITS;
  • BUSINESS INTERRUPTION.

OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN AS MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) SHALL NOT EXCEED THE AMOUNT OF FIFTY DOLLARS ($50.00) OR THE AMOUNT YOU PAID FOR THE APP, WHICHEVER IS GREATER.

8. Updates and Changes

We may from time to time provide enhancements or improvements to the features/functionality of the App ("Updates"). Updates may modify or delete certain features. You agree that we have no obligation to provide any Updates or to continue to provide or enable any particular features.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, excluding its conflicts of law rules. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Kings County, New York.
